General Terms and Conditions – LUYX
1. General
1.1 These general terms and conditions apply to all offers, orders, and agreements made through the LUYX website.
1.2 By placing an order, the customer declares to have taken note of and agreed to these general terms and conditions.
1.3 LUYX reserves the right to amend these general terms and conditions. The most current version is always available on the website.
2. Offers and Agreements
2.1 All offers on the website are non-binding unless explicitly stated otherwise.
2.2 An agreement is concluded at the moment LUYX confirms the order by e-mail.
2.3 Images and product descriptions serve as indication. Since candles are handmade, colors, shapes, or scents may vary slightly.
3. Prices and Payments
3.1 All prices are listed in euros and include VAT.
3.2 Any shipping costs are clearly stated during the checkout process.
3.3 Payment must be made via the payment methods offered on the website, including MultiSafepay and PayPal.
3.4 LUYX reserves the right to change prices, provided that price changes do not affect agreements already concluded.
4. Delivery
4.1 Orders are generally shipped within 1–3 working days after receipt of payment, unless stated otherwise.
4.2 Stated delivery times are indicative and do not constitute a strict deadline.
4.3 If delivery proves impossible, LUYX will inform the customer as soon as possible and refund the amount paid.
4.4 The risk of loss or damage to products passes to the customer at the moment of delivery to the specified address.
5. Right of Withdrawal and Returns
5.1 The consumer has the right to withdraw from the agreement within 14 days after receipt of the product without stating reasons.
5.2 During the reflection period, the consumer must handle the product and packaging with care.
5.3 Candles must not be lit or used if the consumer wishes to exercise the right of withdrawal. Used, burnt, or damaged candles are not eligible for return.
5.4 If the right of withdrawal is exercised, the product must be returned within 14 days after withdrawal, if reasonably possible in its original condition and packaging.
5.5 The costs of return shipping are borne by the consumer, unless otherwise agreed.
5.6 LUYX will refund the paid amount, including any standard shipping costs, within 14 days after correct receipt of the return via the same payment method.
6. Warranty and Conformity
6.1 LUYX guarantees that the delivered products comply with the agreement and legal requirements of conformity.
6.2 Candles are consumable products. Burning, melting, discoloration, or deformation due to heat or use does not constitute a defect.
6.3 Because candles are handmade, minor variations in color, scent, or shape may occur. These variations do not constitute a defect and do not entitle to warranty.
6.4 Warranty is void if damage results from improper or unsafe use, accidents, or alterations to the product by the customer.
7. Liability and Safety
7.1 LUYX is not liable for indirect damage, consequential damage, or lost profits, unless caused by intent or gross negligence.
7.2 LUYX's liability is in all cases limited to the amount of the relevant order.
7.3 Candles and decorative items must only be used according to the provided safety instructions.
7.4 LUYX is not liable for damage caused by improper or unsafe use of candles, including but not limited to leaving candles unattended or ignoring safety warnings.
7.5 Use of candles is always at own risk.
8. Reviews
8.1 LUYX may display customer reviews on the website.
8.2 If applicable, it will be clearly stated whether a review comes from a verified purchase.
8.3 Reviews will not be edited or removed unless they conflict with the law, these terms, or generally accepted standards (such as offensive, misleading, or spam content).
9. Privacy
9.1 LUYX processes personal data in accordance with applicable privacy legislation.
9.2 For more information on the processing of personal data, please refer to the Privacy Policy on the website.
10. Applicable Law and Disputes
10.1 All agreements between LUYX and the customer are governed by Dutch law.
10.2 Disputes are preferably resolved through mutual consultation. If this is not possible, the dispute will be submitted to the competent court.
